The H1B clock
The 60-day grace period after a layoff
USCIS guidance describes a grace period of “up to 60 consecutive calendar days or until the end of the authorized nonimmigrant validity period, whichever is shorter” after H-1B employment ends. In that window you can, among other options, become the beneficiary of a new employer’s petition (USCIS: options after termination). Sixty days is roughly eight working weeks to go from first application to a filed petition.
That window is under review. On 10 September 2026 DHS published a proposed rule to eliminate the discretionary 60-day grace period for H-1B and several other categories, and the current grace period remains in effect while it is reviewed, according to Envoy Global. Rules are moving, so check with an immigration attorney about your own case.
The cap and the weighted lottery
If you are not yet counted against the cap, timing is set by the lottery. For FY 2027, registration ran from 4 to 19 March 2026 with a $215 fee, and selection was weighted toward higher wage levels for the first time, according to USCIS. USCIS also notes that some selected petitioners may need to pay an additional $100,000 under a September 2025 proclamation. USCIS has not announced the FY 2028 registration window yet; the last three cycles opened in March.
If you already hold H-1B status, a new employer usually files a change-of-employer petition rather than entering the lottery again. Either way, the employer has to be willing to file, which is why the sponsor filter comes before everything else.
Where to check who sponsors
- USCIS H-1B Employer Data Hub: the official source. It covers petitions “from fiscal year 2009 through fiscal year 2026 (quarter 3),” searchable by employer, city, state, ZIP and industry code, with CSV downloads (USCIS Data Hub).
- H1BGrader: combines Department of Labor LCA data with USCIS approvals and grades employers on their sponsorship record (H1BGrader).
- MyVisaJobs: sponsor rankings and job categories. Its own advice: “Your best chance of being hired is with U.S. employers that have previously sponsored foreign workers with your skill set” (MyVisaJobs).
These sites tell you who sponsored in the past. They do not apply for you, and past sponsorship is not a promise for a specific role.
Why tailored beats volume when you are on a clock
A tool that sends 1,000 applications a day sounds right when time is short. But every application to an employer that will not sponsor is wasted, and career-page forms often ask about work authorization up front. Autopilot, a beta for some Simplify+ members, submits on supported portals with 20 credits a week that do not roll over. It does not send outreach emails.
